1. Acceptance of Terms

By accessing or using our website, booking services, purchasing products, joining memberships, or communicating with us via SMS/email, you agree to these Terms & Conditions (“Terms”) and our Privacy Policy and Notice of Privacy Practices (HIPAA), each incorporated by reference. If you do not agree, do not use the site or services.

2. Medical & Professional Disclaimer

  • Not Medical Advice: Content on this site (including blogs, videos, testimonials, before/after photos) is for informational purposes only and does not constitute medical advice. Individual results vary.

  • No Patient-Provider Relationship: Viewing the site or submitting information does not establish a patient-provider relationship. A relationship is formed only after clinical intake, evaluation, informed consent, and acceptance by our providers.

  • Emergency: Our services are not for emergencies. For emergent issues, call 911 or go to the nearest ER.

  • Contraindications/Risk: All treatments carry risks, including but not limited to bruising, swelling, infection, pigment change, scarring, vascular complications, and rare severe outcomes. Disclose all medical conditions, allergies, medications, and history honestly.

3. Eligibility; Minors

  • You must be at least [18] years old to book or receive services.

  • Minors ([under 18]) may only receive non-invasive services with custodial parent/guardian consent and physical presence, if permitted by our policy and Florida law. We reserve the right to refuse service.

4. Appointments, Cancellations & No-Show Policy

  • Booking Deposit: A deposit may be required to secure appointments. Deposits are applied to services and are non-refundable] subject to this policy.

  • Cancellation Window: Cancel or reschedule at least 24 hours before your appointment to avoid a fee.

  • Late/No-Show Fees: Late arrivals may reduce treatment time or be rescheduled. No-shows incur a fee of $100 and may forfeit deposits.

  • Pre-Procedure Requirements: Follow all pre/post instructions. Failure to do so may result in rescheduling or additional risk.

5. Payments, Pricing & Promotions

  • We accept Visa/Mastercard/AmEx/Discover/Cash/HSA/FSA*, Venmo, Zelle, CashApp and Affirm financing. All prices are in USD and subject to change without notice.

  • We may run limited-time promotions with specific terms. Promotions cannot be combined unless expressly stated.

  • If a pricing or typographical error occurs, we may cancel orders/appointments and refund amounts paid.

* HSA/FSA acceptance depends on plan rules and service type; not all aesthetic services qualify.

6. Refunds & Returns

  • Services: Due to the nature of aesthetic services, no refunds once services are rendered.

  • Products: Unopened products may be returned within 5 with receipt. Opened skincare may be returned only if defective or adverse reaction documented within5 days.

  • Packages/Memberships: See Section 8.

  • Prepaid/Deposits: Subject to cancellation policy and any stated non-refundable terms.

7. Gift Cards & Vouchers

  • Gift cards are non-refundable, not redeemable for cash, and valid for 1 year unless prohibited by law.

  • Lost or stolen cards will not be replaced.

  • Gift cards may not be used for gratuity/taxes unless stated.

8. Memberships, Packages & Financing

  • Memberships: Auto-billed monthly. Benefits and discounts are for active members only and non-transferable.

  • Cancellation: Cancel with 5 days notice before renewal through portal/email/in-person. Early termination fee: None.

  • Packages: Must be used within 12 months of purchase; unused portions may expire. No partial refunds, except where required by law.

  • Financing: If offered via third parties (e.g., CareCredit), you agree to their separate terms.

9. Telehealth & Virtual Consults

  • Telehealth is subject to Florida law and provider licensure.

  • You consent to telehealth risks, limitations, and technology issues. We may request in-person visits at our discretion.

10. Photos, Testimonials & Marketing Consent

  • Before/After Photos: We may take clinical photographs to document care. Clinical photos are part of your medical record.

  • Marketing Use: We will only use photos/testimonials for marketing with your separate written consent. You may revoke consent prospectively.

  • Results: Testimonials and images are not guarantees of outcomes.

11. Communications; SMS/Email Consent

  • By providing your phone/email, you consent to receive appointment reminders, updates, and marketing communications. Message/data rates may apply.

  • Opt-Out: Reply STOP to SMS or use unsubscribe links in emails.

  • We comply with applicable TCPA and anti-spam rules. Some transactional messages are required for service delivery.

12. Website Use & Content

  • Intellectual Property: All content is owned by or licensed to us and protected by law. You may not copy, adapt, distribute, or exploit site content without permission.

  • Acceptable Use: Do not misuse the site (e.g., hacking, scraping, spam, impersonation, or infringing activities).

  • Accuracy: While we strive for accuracy, content may contain errors or be updated without notice.

13. User Accounts

  • You are responsible for safeguarding login credentials and for all activities under your account. Notify us of any unauthorized access immediately.

14. E‑Commerce Terms 

  • Order Acceptance: We may refuse/cancel orders for suspected fraud, errors, or policy violations.

  • Shipping: Ships to Florida only. Estimated delivery varies.

  • Risk of Loss: Transfers upon delivery to carrier.

  • Defects: Report within 5 days of delivery with photos for resolution.

15. Health Information & Privacy

  • We maintain a Notice of Privacy Practices (HIPAA) for protected health information (PHI).

  • Non-PHI site data is governed by our Privacy Policy (cookies, analytics, marketing pixels).

  • Do not upload or transmit sensitive information unless requested by our clinical team via secure channels.

17. Third‑Party Links & Services

Our site may link to third-party sites or use third-party tools. We are not responsible for their content, policies, or practices. Use them at your own risk.

18. Limitation of Liability

To the fullest extent permitted by law, South Shore Aesthetics and Wellness, its owners, employees, and contractors disclaim liability for indirect, incidental, consequential, special, or punitive damages arising from site use, services, or products, even if advised of the possibility. Our total liability for any claim shall not exceed the amount you paid for the applicable service/product.

19. Indemnification

You agree to indemnify, defend, and hold harmless South Shore Aesthetics and Wellness and its affiliates from claims, damages, liabilities, costs, and expenses arising from your site use, policy violations, misrepresentations, or misuse of services/products.

20. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (e.g., weather, power outages, supply chain issues, public health emergencies).

21. Governing Law; Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue for disputes is the courts of Hillsborough County, Florida or the U.S. District Court for the Middle District of Florida.

22. Dispute Resolution; Arbitration (

Any dispute arising out of these Terms or services shall be resolved by binding arbitration administered by [AAA/JAMS] under its rules. Class actions and jury trials are waived. You may opt out within [30 days] of first use by notifying [email] in writing.

23. Changes to Terms

We may update these Terms at any time. Changes become effective upon posting the “Last Updated” date. Continued use constitutes acceptance.

24. Severability; Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
